1. Purpose of this Policy and status of the Service
1.1. This Policy explains how illegal Content stored in GigantHost can be reported and how the Provider handles such notices.
1.2. GigantHost is a private online storage service that stores files at the request of Users. It is a hosting service for the purposes of the DSA. Content is private by default and is made available to third parties only through targeted sharing by a User.
1.3. GigantHost is not an online platform. The Service does not operate a public catalogue or public search and does not recommend or actively disseminate Content to the public.
1.4. The Provider is not subject to a general obligation to monitor stored Content or actively seek illegal activity. It does not use automated tools to detect illegal Content.
2. How to report illegal Content
2.1. A notice must be submitted exclusively by electronic means:
- by email to [email protected], or
- through the form at https://giganthost.com/contact.
2.2. A notice must be sufficiently precise and substantiated. In particular, it should include:
- an explanation of why the Content is considered illegal;
- the exact electronic location of the Content, such as its URL or a link to the shared file;
- the reporting person’s name or entity name and contact email, except where the DSA permits an anonymous notice;
- if the reporting person acts on behalf of the owner or another holder of rights affected by the reported Content, a document evidencing the reporting person’s authority to act on that party’s behalf, in particular a power of attorney, authorisation or other legal basis for representation;
- a statement that the notice is submitted in good faith and that the information provided is accurate and complete to the reporting person’s best knowledge.
2.3. If a contact email is provided in the notice, we may use that address to send an acknowledgement of receipt and, where appropriate, information about the decision taken after assessment.
3. Assessment of notices and possible measures
3.1. Content is not removed automatically merely because it has been reported. We assess notices in a timely, diligent, objective and proportionate manner.
3.2. If Content is illegal or breaches the Terms of Service, we may in particular:
- disable access to or remove the Content;
- invalidate a sharing link;
- restrict access to the Content;
- restrict, suspend or terminate a User Account;
- inform the competent authorities where required by law or by the nature of the matter.
3.3. If we become aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, we will inform the competent authorities without undue delay in accordance with Article 18 DSA.
4. Information about decisions
4.1. We may use the contact email provided by a reporting person to communicate our decision concerning the reported Content.
4.2. If we take action against a User’s Content or Account, we will provide the affected User with a clear and specific statement of reasons to the extent required by the DSA and other applicable law.
5. Final provisions
5.1. Rules governing permitted and prohibited Content are also set out in the GigantHost Terms of Service.
5.2. We may update this Policy. The current wording is always available at https://giganthost.com.
